1. Acceptance of Terms

By using Atypos.family, you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the service. These terms form a legally binding contract between you and the operator of Atypos.family (full identification in the Privacy Policy).

2. What is Atypos.family

Atypos.family is a content platform that helps caregivers of neurodivergent children and adolescents create a practical, personalised manual about their child's unique way of being. The service is NOT a health provider — it does not perform clinical diagnosis, does not issue reports, and does not replace professional care.

If your child needs a professional assessment or ongoing care, please consult a qualified specialist.

3. Who can use it

To use Atypos.family, you must:

• be at least 18 years old
• be the legal guardian of the child or adolescent whose manual you are creating — parent, tutor, guardian, or any person legally authorised to represent the minor
• provide truthful information when registering

Use by persons under 18 is not permitted. If we identify use by a minor, we may immediately close the account.

For autistic/ADHD adults (Manual of Me): the manual subject is the adult user themselves — no legal guardian restriction applies. The legal bases for this flow are contract (LGPD Art. 7 V) and, for sensitive health data, specific and prominent consent of the data subject themselves (LGPD Art. 11 I).

4. Payment and Refunds

4.1 Payment methods: Credit card processed by Stripe (US); PIX processed by AbacatePay (Brazil).

4.2 Available products: Full manual (one-time purchase); Diary (recurring monthly subscription); Additional products (grandparent booklet, audiobook, cards, letters) — one-time purchase per item.

4.3 Refund policy: You have 7 calendar days from the purchase date to request a refund (CDC Art. 49). Given the digital nature of the product, refunds may be limited after manual generation has begun (service consumption) — assessed on a case-by-case basis in accordance with the CDC. Request by email: encarregado@atypos.family with subject Refund. After 7 days, we do not issue refunds for one-time purchases. For subscriptions (Diary): cancel anytime; access continues until the end of the paid period; no pro-rata refund.

5. Intellectual Property

5.1 Your manual belongs to you: The manual generated from your answers is yours. You may use it freely: send it to school, print it, share it with family, keep a digital copy.

5.2 What Atypos.family retains: Atypos.family retains the right to process manual content for up to 90 days after generation, exclusively for operational technical debugging. After 90 days, AI prompts and outputs are automatically deleted. The manual remains available to you.

5.3 Platform ownership: The code, design, brand, texts, and other elements of Atypos.family are the exclusive property of the operator. You may not reproduce, copy, or distribute the platform or its components.

6. Limitation of Liability

Atypos.family is provided as-is and as-available. We are not liable for:

• decisions made based on the manual without consulting a qualified professional
• errors or inaccuracies in AI-generated content
• indirect damages, lost profits, or consequential damages
• failures of third-party services (Stripe, AbacatePay, Supabase, Anthropic, etc.)

Our maximum liability is limited to the amount paid for the service in the last 12 months.

This limitation does not exclude rights guaranteed by the Brazilian Consumer Defence Code (CDC) that cannot be waived by contract.

7. Suspension and Cancellation

7.1 Cancellation by user: You may close your account at any time at /account — Close account. Upon closure: personal data removed per the Privacy Policy; manual access terminated; no automatic refund (see Section 4.3).

7.2 Suspension by Atypos.family: We may suspend or close your account without prior notice in cases of fraudulent use, attempts to circumvent security systems, serious violation of these Terms, or judicial/regulatory order. In suspension cases due to violation, no refund will be issued.

8. Changes to Terms

We may change these Terms at any time. When we make material changes: we will send an email with at least 30 days' notice; the last updated date will be changed. Continued use after the effective date implies acceptance. If you do not agree, you may close your account before the new terms take effect.

9. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federative Republic of Brazil. For dispute resolution, the courts of the City of São Paulo, State of São Paulo, are elected, with waiver of any other, however privileged. The parties agree to attempt to resolve any disputes through mediation or direct negotiation before resorting to the courts, without prejudice to urgent measures requiring immediate judicial relief.
